Congratulations to the 2006 Hawaii legislature for reversing the poor Hawaii Supreme Court decision in Wilson v. AIG (October 28, 1998)! That case held that under Hawaii's no-fault (PIP) law - in most cases only a medical provider (and not the insured patient) could enforce a PIP insurance policy and bring an action against an insurer to compel non-payment of the medical bills. Obviously, the providers are too busy to do this - and as a result fat-cat foot-dragging insurers kept their money - seriously hurting the medical providers. However, this year in the committee reports to SB 3072, the legislature explained that Wilson was being reversed and that this case was NOT what it had EVER intended. Once again medical providers under no-fault (PIP) who are not properly paid will find a strong ally in their patient and their patient's lawyer to "Make 'em pay"!

In addition, in other cases, the injured parties may be able to pursue insurance coverages that are designed to fill in such gaps - such as Uninsured Motorist Insurance and/or Underinsured Motorist Insurance.
