Explosion, Demolition & Blasting Accidents in Hawaii
Deadlines to File Explosion, Demolition & Blasting Accident Claims in Hawaii
The
deadline for most explosion, demolition & blasting accident
claims in Hawaii is two (2) years from the date of the injury.
It should be noted, however, that there are exceptions to this rule- for example, claims
against the City and County of Honolulu and the various other Counties must be filed with the appropriate agency
within six (6) months of the date of the accident. In many explosion accident
cases, the claim deadlines of other jurisdictions come into play and choice of law
rules may shorten the deadlines to one year or another length of time. Whatever
the deadlines may be, you must file your claims in
court prior to the expiration of such deadlines, or your
claims may be lost—regardless of their merit.
To be wise it is recommended that you immediately contact an attorney
after an explosion, demolition & blasting accident giving rise to injuries occurs. If you wish to
do so now, please do not
hesitate to contact us here at

Explosion, Demolition & Blasting Accidents in Hawaii
Explosion, demolition & blasting accidents are very dangerous.
Explosion, demolition & blasting accidents are likely to cause death and serious injury.
Thus, there are special laws that regulate and precautions that are
necessary whenever a person or business is dealing with explosive
materials.
Types of explosion, demolition & blasting accidents which have been known to occur-
and which may occur again- include, but are not limited to:
- Accidents during the trucking, air freight or other delivery
of explosive materials
- Unexploded ordnance accidents
(Hawaii still has unexploded
ordnance from WWII and training exercises)
- Demolition and blasting cap accidents, esp. during sitework and excavation
- Accidents involving the sale or storage of petroleum products and other explosive materials
- Automobile gas tank design defects
- Battery explosions
- Fireworks accidents, esp around New Year's and the 4th of July
- Pressurized consumer products, especially when heated in Hawaii's sun
- Unguarded and unsafely stored or abandoned explosive materials
If an explosion accident injury occurs as a result of the negligence or
fault of someone other than the employer of the victim, there probably
will be a valid claim against the actual party at fault.
If you or someone you love were seriously injured in an
explosion accident,
you may want to consult with an attorney to assist you with your situation.

In April of 2008 USAA was punished to the tune of $3.5 million in punitive damages for malice, oppression and fraud committed against a policy holder who bought one of its homeowners' insurance policies for a home in Oceanside, California, according to the Fresno Bee. The homeowner, a Marine captain who did 3 tours of duty in Iraq, suffered over $80,000 in water damage to his home and its foundation when a pipe burst as a result of construction performed during an addition to his home. Instead of promptly investigating and paying the claim, USAA found excuses to avoid payment and delay the resolution of the claim. The jury's verdict was apparenly intended to try to discourage such business practices. Colombero v. USAA, ___ (Cal. 2008)
