The Sereboff Case - ERISA Plans Preferred to the Financial Recovery of Injured Workers

An ERISA plan's "equitable relief" against a 3rd party tort recovery may allow it to claim the proceeds of a personal injury claim to repay medical expenses advanced by the plan - even though this denies that same recovery to its own patient, the injured worker. The US Supreme Court has apparently ruled it is more important for an ERISA plan to be able to pass off some of the medical benefits which it promises to provide to injured workers to the wrongdoers who injured the workers - than it is for those workers to be able to recover their lost earnings or otherwise be made whole from that recovery so that the workers can get back on their feet again after their injuries. Sereboff v. Mid Atlantic Medical Services, Inc., U.S. Supreme Court No. 05–260 (decided May 15, 2006)
